1) Photography Session Fees

The session fee covers the photographer’s time and talent with only the number of images stated in the package bought. Payment for the selected package is due at time of booking, once the client booking form has been completed. Session fees taken for any portrait photography session are non-refundable except in the event Sarah Michelle (photographer) cancels the booking. 

2) Digital Image Packages

All photography session packages come with the number of digital images chosen by the client. If booking two or more Digital Image Packages they cannot be split multiple shoots you will be expected to select your favourite images from each gallery at the time that gallery goes live and then purchase the appropriate package, the same process is followed for each shoot thereafter.  The minimum package is for a set of 3 digital images.

 

3) Sickness
We understand that children can be unpredictable and fall ill at any time. In the event of sickness prior to the session, the Client agrees to make every possible effort to inform Sarah Michelle Photography no later than 4 hours prior to the start time of the photography session. The session can be transferred to a new date which will be at the convenience of both parties within a maximum 4 week period. Sarah Michelle Photography reserves the right to re-schedule outside of this time limit due to any existing commitments. If the Client fails to reschedule within the 4 week time period, Sarah Michelle Photography has the right to cancel the booking with the session fee payment made non-refundable. If a client is a no show, there will be a rebooking fee charged.

4) Session

Sarah Michelle shall be entitled to her judgment regarding the style and flow of the session. This includes but is not limited to poses, props, and number of images taken. Due to the willingness of subjects, it may not be possible to capture all the pictures requested or images to the client’s full expectations. In the event of uncooperative children at a session of any kind, for any reason, Sarah Michelle may not be able to capture any, or all the images the Client may have requested or expected. The Client is responsible for all children at all sessions.

 

5) Price of Products
Session fees only include the number of images in the selected package and do not include products (unless stated in the info or offer details). Once the session has taken place there will be an opportunity for the Client to select additional images and products to purchase for an additional fee.

 

6) Fulfillment of Obligations
Sarah Michelle (Photographer) shall not be liable to the Client for any failure, in whole or in part, to fulfil her obligations where failure arises as a result of an event or circumstances beyond her control, which may include (but are not limited to) equipment failure, inclement weather, illness or injury. The Client understands and accepts that the photographic coverage will be as Sarah Michelle’s professional expertise determines. Special requests are not binding instructions although every effort is made to comply with the Client’s wishes. In the unlikely event of total photographic failure or cancellation of the contract by Sarah Michelle’s liability shall be limited to a full refund of all monies paid.

7) Artistic Input – Images

Sarah Michelle shall be entitled to her judgment regarding the style and artistic input in the production of pictures. The editing process is a large part of the finished image and reflects the artistic style of Sarah Michelle. Images are fully edited before presenting to Client. Additional edits are carried out at the discretion of Sarah Michelle, and Sarah Michelle reserves the right to charge the Client for additional editing to cover the time involved. Raw files are not available for purchase by the client.

 

8) Proofs/View and Order Session
There is no guarantee that any particular number of proofs will be produced. Proofs will be available for your view and order session or online gallery within usually 3 weeks (although this may be extended during busy periods). All orders are due at this time. Sarah Michelle is not obligated to provide the client with any images that are not already presented to them. The client is responsible for viewing and ordering from their online gallery within 3 days of the images being ready for viewing. For all orders, payment is due in full at time of order. All portrait orders are final and cannot be changed or refunded for any reason.

 

9) Copyright & Reproduction
Copyright is retained by Sarah Michelle at all times throughout the world. No image can be copied, scanned or reproduced in any form whatsoever without the prior consent of Sarah Michelle. The Client may not alter or add to or manipulate a picture by any means or reproduce a picture in whole or in part as an element within, or as a montage with, another picture without Sarah Michelle's’ written permission. Permission to reproduce a picture for personal use (not commercial) is granted to the Client by Sarah Michelle only when digital images jpegs are purchased and paid in full by the Client to Sarah Michelle.

 

10) Use of Pictures
Sarah Michelle retains the right in all cases to use any pictures for the purposes of social media and website portfolio. For advertising or publication usage Sarah Michelle will always gain written permission from the client.

 

 

11) Receipt of Portraits, Wall Art or Products

All orders are presumed to have been received in good condition unless the Client notifies Sarah Michelle in writing of any discrepancy or error within 14 days of receipt. All portraits, books, albums, frames, etc. are non-refundable.
 

12) Cooling off period

Orders cannot be cancelled due to the custom nature of the products. Orders are made to the Client’s personal specification, (i.e. image number, print size, frame style, etc.), the Client does not have the right to a cooling off period. By placing an order with Sarah Michelle you are committing to buy the ordered products.

 

13) Returns Policy
Incorrectly supplied items and items of poor quality can be returned and will be replaced at no extra charge to the Client. Returns will not be considered for incorrectly ordered items or items ordered in error.

 

14) Digital Files

Sarah Michelle reserves the right after a period of 6 months from the Client's session date to delete all or any images. After receiving purchased images Lullaby Photography will no longer be responsible for storing Clients image files. After receiving the digital file transfer it is Clients responsibility to check the images within 7 days. If any of the digital files are faulty or corrupted Sarah Michelle will replace it at no extra cost (within the 7 days after download). It is the clients responsibility to make sure that you make multiple copies on your computer, cloud or any other storage. If the client needs any of the digital files to be replaced once it has passed 7 days after the initial download, there will be a £10 admin to resend any of the digital files.

16) Clients Own Cameras and Recording Devices

Cameras, mobile phone cameras, and camcorders are NOT permitted during any session, in the studio or on location without express permission from Sarah Michelle.

17) Covid-19 

Due to current covid situation and Christmas Mini Sessions being a festive theme (unavailable in other part of year), if any lockdown is put in place and the sessions cannot go ahead or be rescheduled before Christmas a refund will be issued. A refund will only be issued if a government lockdown is put in place. In the event of any attendees display symptoms of Covid-19 or any other illness, your shoot will be rescheduled, you MUST NOT attend.
